How TG International collects, uses, shares, and protects personal information

This Policy explains how TG International processes personal information through its website, business enquiries and related commercial activities. It is intended to provide the notification required when personal information is collected and should be read with any transaction-specific privacy notice or contractual term.

TG International is the responsible party for the processing described here unless another party is identified for a particular activity.

1.  Scope

This Policy applies to website visitors, prospective and existing business customers, customer and supplier representatives, service-provider contacts, agents, consignees and other individuals whose personal information TG International processes in connection with enquiries, sourcing, exports, logistics and administration.

The website and TG International's services are directed to businesses and are not intended for children.

2.  Personal information we collect

Depending on the relationship and transaction, TG International may collect:

  • identity and contact details, including names, job titles, employer or business details, email addresses, telephone numbers and physical addresses;
  • enquiry and correspondence information, including messages, product interests, destinations, requested quantities and communication records;
  • commercial and transaction information, including quotations, orders, invoices, payment status, banking confirmations, credit information where lawfully obtained, delivery instructions and transaction history;
  • export and logistics information, including consignee and notify-party details, shipping documents, customs or permit information, identification details where required by law, and records supplied to carriers, banks or authorities;
  • supplier, agent and service-provider information needed for sourcing, contracting, payment and compliance; and
  • technical website information, including IP address, device and browser information, pages visited, referring source, approximate location derived from IP, cookie identifiers, security logs and website interaction data.

TG International does not intentionally request special personal information through the public website. Please do not submit unnecessary identity documents, health information or other sensitive information in a general enquiry.

3.  Sources of information

TG International generally obtains personal information directly from you or from the organisation you represent. It may also receive information from customers, suppliers, agents, freight forwarders, carriers, banks, insurers, customs or regulatory authorities, publicly available business sources, fraud-prevention or compliance providers, and website or analytics providers.

4.  Why we process personal information

TG International processes personal information where it is necessary and proportionate for one or more of the following purposes:

  • to receive, assess and respond to enquiries and quotation requests;
  • to source products, prepare quotations, perform contracts and manage customer or supplier relationships;
  • to arrange export, import support, freight, warehousing, insurance, customs, inspection, banking and payment processes;
  • to verify identities, authority, destination details, bank details and commercial information;
  • to comply with tax, accounting, company, customs, sanctions, anti-fraud, food, export-control, recordkeeping and other legal or regulatory obligations;
  • to operate, secure, troubleshoot and improve the website and business systems;
  • to establish, exercise or defend legal rights and manage complaints or disputes; and
  • to send relevant business communications or lawful direct marketing, subject to applicable consent and opt-out requirements.

5.  Legal grounds

TG International processes information on one or more grounds recognised by the Protection of Personal Information Act 4 of 2013, including consent; the conclusion or performance of a contract; compliance with a legal obligation; protection of a legitimate interest of the individual; or pursuit of TG International's or a third party's legitimate interests where the individual's rights and reasonable expectations are appropriately considered.

Where processing is based on consent, you may withdraw that consent prospectively. Withdrawal does not affect processing already carried out lawfully and may not prevent processing required for another lawful reason.

6.  Whether information is mandatory

Providing information through a general website enquiry is voluntary. Certain information becomes necessary if TG International is to prepare a reliable quotation, contract, invoice, export document or shipment instruction, or comply with law. If required information is not provided, TG International may be unable to respond fully, quote, accept an order, arrange a shipment, process payment or continue the relationship.

7.  Cookies and analytics

The website may use the following categories of cookies or similar technologies:

  • strictly necessary cookies used for security, network management, form operation, consent preferences and core website functions; and
  • analytics cookies used to understand aggregated website traffic, page performance and how visitors find and use the website.

Non-essential analytics cookies should be activated only after the visitor has made the applicable consent choice. Visitors must be able to reject non-essential cookies as easily as they accept them and to change their preference later. Browser settings may also be used to block or delete cookies, although this may affect website functionality.

The website operator should keep the cookie banner and this section aligned with the actual tools deployed. If advertising pixels, remarketing, embedded social media or newsletter tracking are introduced, this Policy and the consent mechanism must be updated before those tools are activated.

8.  Sharing personal information

TG International may disclose relevant personal information, on a need-to-know basis, to:

  • customers, suppliers, manufacturers, agents, consignees and other transaction participants;
  • freight forwarders, carriers, warehouses, ports, customs agents, inspection bodies, laboratories and insurers;
  • banks, payment providers, foreign-exchange providers, accountants, auditors, legal advisers and debt-recovery providers;
  • website hosts, email providers, cloud and IT support providers, analytics providers and cybersecurity providers;
  • government, customs, tax, port, law-enforcement or regulatory authorities where required or permitted by law; and
  • a purchaser, investor or adviser involved in a proposed business reorganisation or transaction, subject to appropriate confidentiality and legal safeguards.

TG International does not sell personal information.

9.  Cross-border transfers

TG International operates in an international supply chain. Personal information may be transferred to or accessed by recipients outside South Africa, including in the United Kingdom, Africa, the Indian Ocean Islands, the Caribbean Islands, South America, Asia and countries used by carriers, cloud providers or other service providers.

TG International will take reasonable steps to ensure that a cross-border transfer complies with section 72 of POPIA, for example because the recipient is subject to an adequate law, binding agreement or corporate rules providing appropriate protection; the transfer is necessary for a contract or for the benefit of the individual; or the individual has consented where consent is the appropriate basis.

10.  Information security

TG International uses reasonable and appropriate organisational and technical safeguards designed to protect personal information against loss, damage, unauthorised destruction, access, disclosure or other unlawful processing. Measures may include access controls, account security, staff confidentiality, secure service providers, backups, system maintenance and incident-response procedures.

No internet transmission or storage system can be guaranteed to be completely secure. If TG International has reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, it will follow the notification and response requirements of applicable law.

11.  Retention

TG International keeps personal information only for as long as reasonably necessary for the purpose collected, to maintain commercial and shipping records, to comply with tax, accounting, customs, company and other legal requirements, or to establish, exercise or defend legal claims.

Retention periods vary by record type and transaction. When information is no longer required, TG International will delete, destroy or de-identify it in a manner appropriate to its sensitivity and format, unless continued retention is required or permitted by law.

12.  Your rights

Subject to POPIA, PAIA and any applicable limitations, you may:

  • ask whether TG International holds personal information about you and request access to it;
  • request correction or deletion of inaccurate, irrelevant, excessive, out-of-date, incomplete, misleading or unlawfully obtained information;
  • object, on reasonable grounds, to certain processing;
  • withdraw consent where consent is the processing basis;
  • object to or opt out of direct marketing; and
  • lodge a complaint with the Information Regulator.

Requests should be sent to the Information Officer at info@tginternational.co.za. TG International may need to verify your identity and authority before acting on a request. Some records may be withheld or retained where law permits or requires this.

13.  Direct marketing

TG International will send electronic direct marketing only where permitted by law. A recipient may opt out at any time by using the unsubscribe facility provided or by emailing the Information Officer. Service, transaction and compliance messages are not marketing and may still be sent where necessary.

14.  Third party websites

The website may link to third-party websites or services. Their privacy practices are governed by their own policies. TG International is not responsible for how an independent third party processes personal information.

16.  Policy updates

TG International may update this Policy to reflect changes in its processing, website tools, service providers or legal obligations. The revised Policy will be published with a new effective date. Material changes will be communicated in an appropriate manner where required by law.
